Chapter 714, Statutes of 2011 (SB 850) takes effect January 1, 2012!
Essentially it requires two things of all health care providers:
- Those who maintain electronic health care records must use a system that records automatically any change or deletion to the record and shall record the identity of who made the change, when it was made (date and time), and what change was made. The automatically made record must be preserved (i.e. a locked audit trail)
- Patients shall have the same right of access to the electronic medical record as they do for medical records otherwise, in accordance with state and federal law.
The overall purpose is to require security of the electronic medical record.
